Abstract
This paper analyzes the termination of the effects of land registration within the Portuguese legal system, as an essential component of the security of real estate transactions and the continuous updating of registry publicity.
Starting with a brief characterization of land registration, its publicity function, and its main substantive effects, the study proceeds to a systematic examination of the regime set out in the Portuguese Land Registry Code, with particular focus on Article 10 and the rules concerning the expiration and cancellation of registrations.
It specifically examines the different forms of termination, namely through transfer by means of a new registration, expiration, and cancellation, as well as the duration of certain registrations, the regime of provisional registrations, and the framework governing judicial sales and their purging effect.
The aim is to demonstrate how these mechanisms dynamically align the situation disclosed in the registry with the actual legal reality, ensuring the protection of the reliance of those who depend on it and contributing to the transparency and stability of real estate transactions.
