Abstract
This study focuses on the condominium legal framework regarding the occupation of areas presumed to be common property by certain unit owners and the construction of structures within those zones. It also examines the possibility of acquiring such areas through adverse possession, the legal requirements for possession, and the potential conversion of the nature of possession. Furthermore, the study addresses the distinction between possession and mere detention, as well as the classification of common areas under the Civil Code. Finally, it analyzes the concept of abuse of rights as a limit on taking belated action against the appropriation of such spaces.
